Why should judges be allowed to chose a murder suspect's sentence?

because he/she is a judge...they are suppose to lay judgement upon someone...its just how it is...overall they are there to gather the evidence and find if its significant enough to convict someone of 1st degree 2nd degree or manslaughter and etc...are some of the judgments wrong? sure they are...but it's life..
